Ukraine Issues Amendments to RoHS Regulation

On June 26, 2019, the UkrainianCabinet of Ministers adopted Resolution № 557 to amend Resolution № 139“Technical Regulations on the Use of Certain Hazardous Substances in Electricaland Electronic Equipment” (also known as Ukrainian RoHS). 

 

The Resolution № 557 entered intoforce on July 3, 2019.

 

The key points of the new document include:

 

1. The Resolution excludes pipe organsproduct group from the scope.

 

2. The compliance deadline of July 1, 2019is removed for mercury in electric rotating connectors used inintravascular ultrasound imaging systems capable of high operating frequency(more than 50 MHz). 

 

3. The aim of the Resolution is to bringthe requirements of the Ukrainian legislation in line with the following EURoHS Directives:

 

  • (EU) 2018/736 as regards an exemption for lead in glass or ceramic for some electrical components
  • (EU) 2018/737 as regards an exemption for lead in solders for the soldering to machined through hole discoidal and planar array ceramic multilayer capacitors
  • (EU) 2018/738 as regards an exemption for lead in cermet-based trimmer potentiometer elements
  • (EU) 2018/739 as regards an exemption for lead as an alloying element in steel
  • (EU) 2018/740 as regards an exemption for lead as an alloying element in aluminium
  • (EU) 2018/741 as regards an exemption for lead as an alloying element in copper
  • (EU) 2018/742 as regards an exemption for lead in high melting temperature solders

 

This amendment is based on Directive(EU) 2017/2102 amending RoHS 2 Directive 2011/65/EU.

 

4. Ukraine would ensure the possibility ofsecondary market operations (e.g. reselling, second-hand market) for electricaland electronic equipment (EEE) newly covered by RoHS 2 and the use of spareparts for such equipment if they are put on the market before July 22, 2019,promoting and enabling the reuse of spare parts. Provided that reuse takesplace in auditable closed-loop business-to-business return systems, and thatthe reuse of spare parts is notified to the consumer, substance restrictionswill not apply to reused spare parts:

 

  • recovered from EEE placed on the market before January 1, 2011 and used in EEE placed on the market before January 1, 2018
  • recovered from medical devices or monitoring and control instruments placed on the market before January 1, 2018 and used in EEE placed on the market before July 22, 2024
  • recovered from in vitro diagnostic medical devices placed on the market before July 22, 2018 and used in EEE placed on the market before July 22, 2026
  • recovered from industrial monitoring and control instruments placed on the market before July 22, 2018 and used in EEE placed on the market before July 22, 2027
  • recovered from all other EEE categories not covered by Technical Regulation approved by Resolution №1057 of the Cabinet of Ministers of Ukraine of December 3, 2008 and which is placed on the market before July 22, 2019 and used in EEE placed on the market before July 22, 2029.
