Malaysia MCMC issues new regulations on WMP / STB certification and import

MCMC (Malaysian communication and Multimedia Commission) decided to impose additional requirements on the certification and import of WMP / STB from January 1, 2022. The current temporary freeze * will remain in force until the new regulations are implemented.
*Note: since March 3, 2020, MCMC has temporarily frozen all applications for certification of new wireless media players and set-top box (WMP / STB) devices.
About the new regulations
From January 1, 2022, all newly applied / renewed certificates of conformity (COC) and certificates of approval (COA) shall meet the following requirement:

1) Not allowed to be sold on the open market;
2) Subscription services or products must be bundled.

1) MCMC certificate: ASP (C), CASP (I) or CASP (C);
2) Letter from MCMC licensee or agreement with Licensee (if applicable);
3) Protocol for conformity certification (type approval) of communication, multimedia and hybrid equipment (latest version);
4) Letter of undertaking.

The owner of the importer / distributor (OEM), or the local brand
|
1) The certificate holder can only sell through its official store or authorized dealer;
2) The certificate holder shall keep detailed records to ensure that the certified products provided to authorized dealers can be traced.

1) evidence of the trademark registration of the company as the brand holder;
2) Letter from the brand holder or contract agreement of the company as an authorized local importer / distributor (if applicable);
3) Protocol for conformity certification (type approval) of communication, multimedia and hybrid equipment (latest version);
4) Letter of undertaking.

In addition to the above additional requirements and conditions, the COC shall comply with the following conditions:
1. Post a warning notice on WMP / STB on violations related to obtaining copyrighted content from unauthorized sources.
2. If necessary, MCMC and / or SIRIM shall be provided with the list of authorized resellers and relevant records traceable to WMP / STB.
The new regulations apply to all WMP / STBs that meet the following criteria:
A. Devices designed to connect TV and networking via WiFi;
B. Running on an open source operating system (such as Android);
C. Devices that enable television to browse the Internet and watch videos online, and
D. For the consumer market (excluding digital signage / advertising machines or WMP / STB for similar purposes).
