Brazil delays mandatory labeling requirements for imported telecommunications equipment

Act 4088 on the certification procedure of ANATEL label was originally scheduled to enter into force on June 31, 2021. The purpose of the act is to provide guidance for the application and pasting of ANATEL label on telecom products. However, by the end of July 2021, ANATEL issued act 5701, delaying and amending the provisions of act 4088 on the certification procedure of labels. According to the latest notice, the effective date will be postponed to July 31, 2022. In addition, ANATEL has added a product category without mandatory labels. Therefore, Now there are four product categories do not require mandatory labels: 

- Semi finished products to be certified imported by the applicant for the purpose of completing products in its territory;  

- The products that need to be pasted with mandatory labels;  

- Products for the importer's own use;  

- Products intended for medical use must be approved by ANATEL and regulated by the laws of ANVISA (national health supervision agency).
